Statement of Work for Redistricting Services for Municipalities

EXECUTIVE SUMMARY

This Statement of Work is by and between GIS Workshop, LLC, a Delaware limited liability company doing business as gWorks (“gWorks”), and the company, organization or governmental entity that signs an Order that incorporates this Statement of Work (“Client”). This Statement of Work (“SOW”) outlines the Services to be performed and/or the Deliverables to be developed (the “Project”) by gWorks pursuant to and governed by the applicable Order that incorporates this Statement of Work and the Master Services Agreement incorporated into such Order. This Statement of Work will also set forth the scope of the Services, a description of the Deliverables, and responsibilities for all parties. Any capitalized terms used, but not defined herein, shall have the meaning ascribed to it in the Master Services Agreement.

PROJECT OVERVIEW

gWorks will provide redistricting services to the Client based on the updated 2020 Census data. Details are provided below.  

PROJECT SCOPE OF WORK

Utilizing the 2020 Census data along with current district maps provided by the Client (in shapefile or PDF format), gWorks will provide the following:

Services

  • gWorks will collect the existing district boundaries from the client.
  • gWorks will utilize 2020 census data to measure the population imbalance between existing districts.
  • gWorks will calculate an updated map that will meet statutory requirements based on the latest census data that will clearly show the new proposed district boundaries along with the population counts.
  • gWorks will provide a one (1) PDF map and one (1) GIS map data layer (in shapefile or geodatabase format) along with an Excel document with demographic breakdowns.
  • Printed hardcopy maps are not included with this SOW. However, printed 48-inch x 36-inch color maps are available for print from gWorks at a discounted rate of $90 per map plus shipping and handling expenses (normally $150 per map).

Deliverables

gWorks will provide a one (1) PDF map and one (1) GIS map data layer (in shapefile or geodatabase format) to the Client that contains:

  • Pertinent political subdivision boundaries
  • City Limits
  • Water Features
  • Roads (Local, State, Federal, and Interstates)
  • Districts (Labeled by number)
  • Incumbent seats (Labeled by name)
  • Achieved District Population

gWorks will provide an Excel spreadsheet that contains the Demographic Breakdowns:

  • District Number
  • Achieved Population per District
  • Target Population per District
  • Standard Deviation between Achieved District Population and Target Population
  • Difference between Achieved Population and Target Population
  • Percent White
  • Percent Black
  • Percent Hispanic
  • Percent Native American
  • Percent Asian
  • Percent Minority
  • Voting Age Percent
  • Voting Age Percent White
  • Voting Age Percent Black
  • Voting Age Percent Hispanic
  • Voting Age Percent Native American
  • Voting Age Percent Asian
  • Voting Age Percent Minority

For Clients Who Purchase the Standard Service

The Client may have up to two (2) hours of revisions and edits to update the map accordingly. Once the initial map is delivered, any time spent on the project, including but not limited to emails, telephone conversations, meetings, and time spent updating the map will count toward the four hours. gWorks staff will provide timely responses to questions and suggestions from the Client and update the maps accordingly. The end result must meet the required guidelines for districts, including a requirement that the end result is within a 5% deviation from the population and districts cannot be divided. gWorks cannot be held liable for any issues or repercussions based on the Client’s decisions.

For Clients Who Purchase the Advanced Service

An initial map will be provided will be used as a reference and starting point. The Client may utilize up to four (4) hours of remote consulting for an immersive, one-on-one data creation experience. Once the initial map is delivered, gWorks will work with the Client to schedule a time to work together and update the maps. This time will come in the form of online meetings and webinars using screen sharing to share and edit the maps as the Client sees fit. gWorks will provide consultation direction, and map editing based on the Client’s requests.

The end result must meet the required guidelines for districts, including a requirement that the end result is within a 5% deviation from the population and districts cannot be divided. Aside from meeting the necessary guidelines, the Client will be able to influence the district boundaries. gWorks cannot be held liable for any issues or repercussions based on the Client’s decisions.

All work will be done remotely; onsite work may be available at gWorks’ discretion and may be subject to additional charges.

Additional or out-of-scope work

Any additional work will be billed at the hourly rate of $160/hour.

CLIENT RESPONSIBILITIES

gWorks expects the Client to provide and/or be responsible for the following items during development and implementation:

  • Provide the current district maps to gWorks staff in shapefile or pdf format along with a list of incumbents and addresses (Map provided in a format other than shapefile or pdf format will be subject to additional conversion costs).
  • Provide a Point of Contact to assist gWorks in accessing the needed public records at County or City Offices.  Furthermore, and if necessary, aid gWorks in gaining access to County Assessor or City officials for Plats as needed.
  • Provide any other data as required.
  • Clarification of any gWorks questions that may occur within two (2) business days).

PROJECT SCHEDULE

gWorks will start the project and provide the PDFs for approval before December 31, 2021, or within eight (8) weeks of the approval of this contract, whichever is later. gWorks cannot be held responsible for delays caused by the Client.

PROJECT COST

Fees are set forth in the applicable Order that incorporates this Statement of Work. The Client agrees to pay all fees set forth in the Order.

PROJECT MAINTENENACE

There is no ongoing maintenance associated with this Project. This Project does not comply with nor fall within the scope of other maintenance SOWs that the Client may have with gWorks.

CHANGE ORDERS

Significant changes in, or additions to, this Statement of Work during the project that requires additional consulting time from gWorks will require a Change Order to detail a revised Statement of Work.  This will ensure that the changes to the Statement of Work are documented and that both the Client and gWorks agree to the changes.

A Change Order reflects the new deliverables, activities, and budget for the remainder of the project.  It amends the Agreement and Statement of Work from the date which is it signed.  Payment for all hours worked and expenses incurred up to the date of the Change Order will be due at this time as they were stated in the original Agreement and Statement of Work.  Additional time detailed in the Change Order will be billed at the gWorks fee structure in effect at the time of the issuance of the Change Order.

TERM AND TERMINATION

This Statement of Work is effective upon the Effective Date of the applicable Order that incorporates this Statement of Work and continues for the term of such Order, unless earlier terminated in accordance with the express termination rights set forth in such Order, if any, and the Master Services Agreement. Upon expiration or termination, Client shall pay gWorks for all Services performed and Deliverables delivered up to and including the date of termination or expiration.  Client may also be subject to an early termination fee at the sole discretion of gWorks.  These post-termination obligations shall survive the termination or expiration of this Statement of Work, to the extent applicable.
